2. PURPOSE OF THE SITE AND DEFINITIONS

The sole proprietorship Claire-Line PEREZ will be referred to as “CLAIRE-LINE DÉLICES” in the legal notice above.

The Claire-Line PEREZ website in the name of CLAIRE-LINE DÉLICES (hereinafter the "SITE") is an e-commerce site that allows the online sale of confectionery products. This SITE is accessible via the Internet at the address www.clairelinedelices.com  on all compatible devices. 

"CUSTOMER" means any natural or legal person who places an ORDER on this WEBSITE

"ORDER" means any ORDER placed by the USER registered on this SITE, in order to benefit from the Services of CLAIRE-LINE DÉLICES

"GTC" designate these GTC for online sale and use.

"CONTENT" designates all the data of the different sections of the SITE

"USER" means any person who makes use of the SITE

 

3. APPLICATION OF THE GENERAL CONDITIONS OF SALE

These GCS are brought to the attention of the CUSTOMER to enable him to place an ORDER.

The fact that the CUSTOMER completes an ORDER on the SITE and confirms it on the SITE constitutes full acceptance of these GCS, which alone will be applicable to the contractual relations of the parties.

 

CLAIRE-LINE DÉLICES reserves the right to modify in whole or in part and at any time without notice these T&Cs for all orders not yet placed by the CUSTOMER.
In the event that one of the clauses of these GCS is void due to a change in legislation, regulations or by a court decision, this can in no way affect the validity and compliance with the other clauses.

 

4. CHARACTERISTICS OF THE GOODS OFFERED

The products offered to the CUSTOMER are those which appear in the catalog published on the SITE within the limits of available stocks, the production capacity of the craftsman and subject to the proper functioning of the SITE.  

Each product is presented accompanied by a photograph and a description drawn up by CLAIRE-LINE DÉLICES. The descriptions are intended to present to the CUSTOMER the essential characteristics of the products before the final ORDER is taken and cannot in any case engage the responsibility of CLAIRE-LINE DÉLICES. The photographs of the products are provided for information only, and are not contractual.

The CUSTOMERS or the recipients of the Products are prohibited from any partial or total resale of the Products.

 

5. ORDER AND CONFIRMATION

 

Customer account

Taking an ORDER on the SITE involves opening a CUSTOMER Account by entering two elements: an e-mail address and a password. The password is and must be kept confidential. CLAIRE-LINE DÉLICES cannot, in any event, be held responsible for fraudulent or abnormal use of the CLIENT's password and/or CLIENT account, and reserves the right to temporarily suspend access to the CLIENT account. in the event that such uses are observed.

The CUSTOMER's right of access to the identifiers can be made on simple request by email, CLAIRE-LINE DÉLICES will then respond only by e-mail to the address used when creating the CUSTOMER Account.

 

Placing an order

To place an ORDER, the CUSTOMER undertakes to complete the constituent elements of his ORDER with precision and rigor. As such, he undertakes to fully complete the various sections necessary for the proper processing of his ORDER:
- Choice of product(s)
- Choice of billing address
- Choice of delivery address
- Choice of delivery date
- Choice of payment method
- Verification and validation of the ORDER and the GCS of Sale
- Full payment of the ORDER

 

Option "Delivery to Lyon Métropole only"

When placing an ORDER, in the event that an item has the option "Delivery to Lyon Metropolis and surroundings only", eligible CUSTOMERS are only those living in the predefined area of the Lyon metropolitan area and postal codes 01700, 01120 and 01390. This area is filled in by a hypertext link in the description of the product in question, in the FAQ and under the "ONLINE SHOP" tab. In the event that an ineligible customer (with a delivery address outside the predefined area) has nevertheless placed an order, CLAIRE-LINE DÉLICES will then reimburse it.

 

 

Order confirmation

CLAIRE-LINE DÉLICES will confirm the ORDER and its payment:
- On the SITE, following payment
- By e-mail, to the e-mail address indicated by the CLIENT

 

The CUSTOMER will have during his ORDER process the possibility of identifying any errors made in the entry of data and of correcting them. The language proposed for the conclusion of the contract is the French language.

 

In the absence of a right of withdrawal in the case of Amezaikus (see 11. RIGHT OF WITHDRAWAL), no request for modification or cancellation can be taken into account once the sale has been confirmed by CLAIRE-LINE DELICES and therefore considered as final.

CLAIRE-LINE DÉLICES reserves the right to refuse an ORDER if the CUSTOMER fails to fulfill one of its obligations, and more generally, to refuse any ORDER that is abnormal or incomplete for any reason whatsoever. CLAIRE-LINE DÉLICES will confirm to the CUSTOMER the acceptance of his ORDER by email.

 

ORDER trackingin the case of the use of the carrier La Poste

As soon as the package is delivered to the carrier, the CUSTOMER receives an e-mail indicating his tracking number, provided that the e-mail address indicated in the registration form does not contain an error. In the case of the carrier La Poste, the CUSTOMER may at any time consult the progress of his delivery by connecting to the Colissimo  website.https://www.laposte.fr/particulier/outils/suivre-vos-envois.
CLAIRE-LINE DÉLICES cannot therefore be held responsible for unavailability or errors that may affect the information provided by its carriers.

 

Proof of ORDER

CLAIRE-LINE DÉLICES, via its host Wix, stores the ORDER forms and invoices in its computer system and under reasonable security conditions.

Accordingly, Wix's computerized records provide a reliable and durable medium that can be produced as evidence in all transactions.

A document summarizing the ORDER form will be provided in the package with the ORDER.

 

6. STOCKS AND UNAVAILABILITY OF PRODUCTS

The availability or unavailability as well as the delivery times are indicated in the descriptive sheets of the Products and are given for information only.

In the event of a permanent out of stock, unavailability of one or more Product(s) ordered or inability to produce, on the delivery times provided for at the time of placing the ORDER, the CUSTOMER may ask CLAIRE-LINE DÉLICES the total refund of the sums paid in payment of this or these Product(s) (excluding personalized article) and the cancellation of the ORDER concerned within seventy-two (72) working hours.

CLAIRE-LINE DÉLICES cannot be held liable for non-performance of the contract concluded in the event of out of stock, unavailability of the Product or inability to produce, due to force majeure, (see chapter 15. Force majeure

 

7. PAYMENT TERMS

Payment for products is made by credit card online from the SITE, through the secure payment system of the CLAIRE-LINE DÉLICES banking establishment. Validation of payment by credit card is immediate. It can also be done by PAYPAL account. Failing receipt of all payment within twenty-four (24) hours following the placing of the ORDER, the latter will be deemed canceled automatically.

 

To be registered, the ORDER must be paid in full. Unpaid ORDERS cannot be processed. The ORDER validated by the CUSTOMER will only be considered effective upon validation of the payment: When the secure bank payment center has given its agreement to the transaction.

 

8. PRICE

CLAIRE-LINE DÉLICES has an individual status therefore VAT is not applicable, according to article 293 B of the CGI. The prices indicated on the purchase orders and invoices will appear in Euros including VAT.

These prices are firm and non-revisable during their period of validity, as indicated on the SITE, the Seller reserving the right, outside this period of validity, to modify the prices at any time.

Delivery costs are charged in addition to the price of the goods. Delivery rates depend on the delivery method chosen (shipping to home or delivery by courier), as well as the geographical area, weight and volume of the package.
 

Any specific and personalized ORDERS from the CUSTOMER may be considered. If necessary, they will be the subject of an estimate previously accepted by the latter. The quotes established by the Seller are valid for a period of eight calendar days, from their date of establishment. The ORDER on estimate is considered accepted only after the total payment of the ORDER. Payment is then made by offline payment.

An invoice is established by the Seller and given to the CLIENT upon delivery of the Products ordered.

 

9. DELIVERY OF PRODUCTS

Shipping and delivery times

Deliveries are only to Metropolitan France.

CLAIRE-LINE DÉLICES, for reasons of product fragility, does not ship on weekends, public holidays and the day before public holidays.

ORDERS placed online via the SITE are collected every day from Monday to Friday, except public holidays. After confirmation of the ORDER, CLAIRE-LINE DÉLICES undertakes to ship the products ordered to the delivery address indicated within a maximum period of twenty (20) days (excluding public holidays, weekends and exceptional temporary closures). This delivery time is established in good faith and is given as an indication and without guarantee, in particular taking into account the average manufacturing time of the products and the hazards of production (does not concern manufacturing kits). CLAIRE-LINE DÉLICES undertakes to ship and deliver within a reasonable time and to notify the CUSTOMER of any possible delay. Unless expressly stipulated in writing to the contrary, a delay of less than thirty (30) days cannot, under any circumstances, justify the cancellation of an ORDER or any compensation whatsoever.

 

  To this is added the carrier's delays, generally 48 hours in the case of the Post Office.

In the Lyon metropolitan area and surrounding municipalities, CLAIRE-LINE DÉLICES reserves the right to carry out the delivery by its own means or by a carrier of its choice at its convenience.

CLAIRE-LINE DÉLICES cannot be held responsible for delays in delivery due to errors or disruptions attributable to carriers (see chapter 15. Force majeure). The information entered for the delivery is the responsibility of the CUSTOMER during payment. No modification may be made subsequently by CLAIRE-LINE DÉLICES in the case of delivery by post.

If the CUSTOMER wants a specific delivery time, he must make a request to CLAIRE-LINE DÉLICES by e-mail. CLAIRE-LINE DÉLICES will then study its request and possibly give its agreement to carry out the ORDER within this period.

CLAIRE-LINE DÉLICES reserves the right to refuse to deliver the items ordered to post office boxes, hotels, cedexes, military bases. In such a case, the CUSTOMER acknowledges that CLAIRE-LINE DÉLICES' obligation for the routing of the ORDER stops at the actual delivery to the collective address indicated by the CUSTOMER on his ORDER form, even though the package is not received by the CLIENT but by a third party.

 

Transport by CLAIRE-LINE DELICES

The day the ORDER is ready to ship, CLAIRE-LINE DÉLICES will contact the CUSTOMER by e-mail or by telephone to agree on a delivery date which will take place within five (5) working days following its notification of the arrangement. CLAIRE-LINE DÉLICES offers deliveries with a time slot between eleven (11) a.m. and six (6) p.m. from Monday to Friday.

CLAIRE-LINE DÉLICES will contact the CUSTOMER by telephone on the day of delivery to confirm its availability in order to avoid any unnecessary travel. If the CUSTOMER or the recipient is absent on the day of delivery, the CUSTOMER'S ORDER is kept by CLAIRE-LINE DÉLICES until reshipment to the requested address has been organised. CLAIRE-LINE DÉLICES will use all necessary means to recontact the CUSTOMER and ensure delivery of the goods to the latter within a maximum period of twenty (20) days after the product has been made available, failing which the CUSTOMER will not may be refunded.

 

Responsibility of CLAIRE-LINE DÉLICES

Loss and damage: In all cases where the personal liability of CLAIRE-LINE DÉLICES would be engaged, for any reason and for any reason whatsoever, it is strictly limited, for all damage to the goods attributable to any operation as a result of losses and damage and for all the consequences that may result, to the exact amount of the missing or damaged goods

Other damage: For all other damage, including in the event of duly noted late delivery, in the event that its personal liability is engaged, the compensation due by CLAIRE-LINE DÉLICES is strictly limited to the cost of transporting the goods. This indemnity may not exceed that which is due in the event of loss or damage to the goods.

 

Carrier La Poste

Packages are sent by Colissimo.

The products are delivered to the delivery address indicated by the CLIENT. The CUSTOMER must verify the completeness and conformity of the information he provides to CLAIRE-LINE DÉLICES. The latter cannot be held responsible for a return of delivery due to an error of address or an impossibility to deliver to the address indicated. In this context, all the costs incurred for a reshipment of the ORDER requested by the CUSTOMER will be entirely the responsibility of the CUSTOMER.

The carrier's delivery time generally observed after shipment is forty-eight (48) hours (excluding weekends, public holidays or exceptional events disrupting transport). This period is indicative and may be longer depending on the possibilities of the carrier. CLAIRE-LINE DÉLICES cannot be held responsible for any delay caused by the carrier and beyond its control. These delays also do not entitle the CLIENT to seek damages.

In the case of a delay in delivery in relation to the deadlines announced by the carriers, the CUSTOMER must first contact the carrier to see if the package is not pending.

 

Upon receipt of the Products ordered, the CLIENT or the recipient must check that the product is in good condition.
In the event that one or more of the Products ordered are missing or damaged, the CLIENT or the recipient must formulate their reservations as completely and precisely as possible in order to be considered valid with the carrier, at the time of delivery.

In all cases, the recipient must, within three (3) days, send the carrier a registered letter with acknowledgment of receipt, in order to remind him of the damage or missing items in detail; this period does not include public holidays. In the absence of registered mail within the time limit, the recipient loses all recourse against the carrier. The CUSTOMER is invited to contact La Poste for more information.

In the absence of reservations, the product is deemed to have been accepted by the CLIENT and cannot be the subject of any dispute concerning its delivery. The CUSTOMER must inform CLAIRE-LINE DÉLICES by e-mail as soon as possible, so that it can take the necessary measures as soon as possible.

In the event of apparent defects in the product, the CUSTOMER has a right of return (see chapter 13. Product warranty) and may demand reimbursement or exchange of the product concerned.

Finally, if the product, under the responsibility of the carrier, has not been delivered, for any other cause related to customs, strikes or damage or any other cause of force majeure as defined (see chapter 15. Force Majeure)

Only the parcel tracking from the transport provider serves as proof of delivery.

In the case of a specific deadline requested by the CLIENT, the delivery slip given by the carrier must be dated and signed by the CLIENT upon delivery of the product. This dated and signed slip will constitute proof of transport and delivery.

 

 

Delivery rates

The cost of delivery payable by the CUSTOMER may vary depending on the weight or value of the items ordered. These costs may also vary depending on the evolution of the carrier's tariffs.

An online ORDER is equivalent to a delivery method. It is not possible to use several delivery methods within the same ORDER.

 

For an amount of up to sixty-nine euros and ninety-nine cents (€69.99) including tax, delivery is set at the rate of five euros and twenty cents (€5.50) including tax.

Delivery is free for any ORDER greater than or equal to seventy euros (€70) including tax.

 

10. STORE COLLECTION

The customer can also come and collect his order at 22 rue Masaryk, 69009 LYON. Withdrawal is free. Once the order has been placed, the customer must wait to receive a notification sent by CLAIRE-LINE DÉLICES confirming that his order is ready before coming to collect it.

11. RIGHT OF WITHDRAWAL

Amezaikus

In accordance with the provisions of Article L221-28 of the Consumer Code, the right of withdrawal does not apply to contracts relating to the supply of the following products:
(I) goods made to the consumer's specifications or clearly personalized

(II) fresh products, products liable to deteriorate or expire rapidly.
(III) goods unsealed by the CLIENT after delivery and which cannot be returned for reasons of hygiene or health protection.

The CUSTOMER therefore has no right of withdrawal for these products.

For candy making kits, the CUSTOMER has a period of fourteen (14) days from receipt of the product to exercise his right of withdrawal from CLAIRE-LINE DÉLICES, without having to justify reasons or pay penalty, at the end of exchange (subject to availability) or refund. If this period expires on a Saturday, a Sunday or a holiday or non-working day, it is extended until the first following working day.

The right of withdrawal must be exercised by email to CLAIRE-LINE DÉLICES using the withdrawal form below. Following this, an acknowledgment of receipt will then be communicated to the CUSTOMER by CLAIRE-LINE DÉLICES.

The products must be returned within fourteen (14) days following notification to CLAIRE-LINE DÉLICES of the CUSTOMER's decision to withdraw, accompanied by the purchase invoice, in their original packaging and in perfect condition allowing their new marketing. in new condition. Dirty, damaged kits or whose box has been opened will not be taken back. Returns must be sent to the address of CLAIRE-LINE DÉLICES.

If the right of withdrawal is exercised within the aforementioned period, only the price of the product(s) purchased will be refunded; the return costs remain the responsibility of the CUSTOMER.

 

The exchange (subject to availability) or reimbursement will be made within fourteen (14) days of receipt, by CLAIRE-LINE DÉLICES, of the products returned by the CUSTOMER under the conditions of this article.

12. COMPLAINTS AND REIMBURSEMENT

The CUSTOMER must ensure that the delivery complies with his ORDER. Any complaint must, to be taken into account, intervene within forty-eight (48) hours of receipt, given the perishable nature of the products.

Complaints should be sent by post to the address of CLAIRE-LINE DÉLICES or by e-mail.

 

Any complaint made after this period cannot be taken into consideration and CLAIRE-LINE DÉLICES will be released from all liability in this respect; CLAIRE-LINE DÉLICES reserves the right to ask the CUSTOMER to return the defective product.

 

If the above-mentioned conditions are met, and in the event of a dispute falling under the responsibility of CLAIRE-LINE DÉLICES, the latter will then proceed to the delivery of a credit note, with a view to the reimbursement of the defective Product(s), or the reshipment of the missing product (subject to the validity of the Buyer's request). The CUSTOMER will then receive a notification by e-mail within twenty-one (21) days of the complaint.

 

13. PRODUCT WARRANTY

Guarantee of conformity and hidden defects

The buyer is entitled to demand that the goods conform to the contract. He cannot, however, contest conformity by invoking a defect which he knew or could not ignore when he contracted. The same applies when the defect has its origin in the materials that he himself supplied.

With regard to perishable products, CLAIRE-LINE DÉLICES guarantees the CUSTOMER that the products are manufactured and packaged according to strict hygiene and quality rules, and stored in accordance with the standards in force in France. CLAIRE-LINE DÉLICES cannot be held liable in the event of non-compliance by the CLIENT with storage conditions and/or optimal instructions, or if the latter has consumed products beyond the expiry date indicated. on the packaging.

As far as pacifiers are concerned, depending on their shape, they may have pointed parts. CLAIRE-LINE DÉLICES is not responsible for any injuries that the soothers could cause.

 

In any case, for all the Products sold, CLAIRE-LINE DÉLICES cannot be held liable in the event of misuse, use for professional purposes, negligence or lack of maintenance on the part of the CUSTOMER. , as in the event of normal wear and tear of the Product, accident or force majeure.

The CUSTOMER may decide to implement the guarantee of conformity or against hidden product defects in accordance with article 1641 of the Civil Code; in this case, he can choose between the resolution of the sale or a reduction of the sale price in accordance with 1644 of the Civil Code.

In order to assert his rights, the CUSTOMER must inform the Seller as soon as possible, in writing, by e-mail or post, of the non-compliance of the Products or of the existence of the hidden defect and return or bring back the defective Products to the store. in the state in which they were received with all the elements (accessories, packaging, instructions, etc.).

The Seller will refund or replace the Products found to be non-compliant or defective.
Shipping costs will be reimbursed on the basis of the invoiced rate and return costs will be reimbursed on presentation of receipts.
Reimbursements for Products deemed non-compliant or defective will be made as soon as possible and at the latest within 14 days following the Seller's finding of the lack of conformity or the hidden defect.
Reimbursement will be made by crediting the CLIENT's bank account used at the time of purchase.

The provisions hereof cannot deprive the consumer of the legal guarantee which obliges the PROFESSIONAL seller to guarantee him against all the consequences of latent defects of the thing sold.

The consumer is expressly informed that the SELLER is not the manufacturer of the products presented on the SELLER SITE and that the SELLER disclaims all liability for defective products.

 

14. INDEPENDENCE OF THE CLAUSES

If one of these GCS should be declared inapplicable or is invalidated for any reason, this invalidity will not affect the application or validity of the other provisions of the GCS, the one invalidated or deemed inapplicable then being replaced by the provision most close as possible.

15. FORCE MAJEURE

Neither CLAIRE-LINE DÉLICES nor the CUSTOMER can be held responsible for any non-performance, non-performance or delay in the performance of one of its obligations described in these GCS which would originate from a case of force majeure. .

 

As such, force majeure means any external, unforeseeable and irresistible event within the meaning of Article 1148 of the Civil Code. Expressly, are considered as cases of force majeure or fortuitous event, in addition to those usually retained by the jurisprudence of French courts and tribunals: total or partial strikes, employers' strikes, riots, civil unrest, insurrections, wars, bad weather, epidemics, blockages of means of transport or supplies for any reason whatsoever, earthquakes, fires, storms, floods, water damage, governmental or legal restrictions, legal or regulatory changes in the forms of marketing, computer breakdowns, blockages telecommunications, including telecommunications networks and any other case beyond the control of the Parties preventing the normal execution of the contract.

16. APPLICABLE LAW

These T&Cs are governed exclusively by French law. The Commercial Court of Lyon will have sole jurisdiction for any dispute or difference concerning them.

Any dispute that may arise between CLAIRE-LINE DÉLICES and a USER during the execution of these conditions will be the subject of an attempt to resolve them amicably. Failing this, the disputes will be brought to the attention of the competent courts of common law.
